Visa Information


Notice of passport return through process.

The Consulate will not entertain any request for return of passport while visa application is under process. Applicants are requested to plan their visit to India keeping this requirement in mind. In case, an applicant wants to borrow his/her passport, he/she can do so by visiting the Consulate during working hours with the original receipt given by the Indian Visa Application Center. However, the Consulate would consider such visa applications as voluntarily withdrawn, would neither refund the visa fee nor return the documents submitted. Such applicants wishing to visit India have to follow the visa procedure afresh as for a new visa.

Tourist visa on Arrival (TVOA) Scheme for citizens of eleven countries.

Citizens of the below mention eleven countries can avail the facility of Tourist Visa on Arrivals in India.
These countries are: Finland, Japan, Luxembourg, New Zealand, Singapore, Cambodia, Vietnam, Philippines, Laos, Myanmar and Indonesia.

Tourist Visa-on-Arrival scheme for citizens of Finland, Japan, Luxembourg, New Zealand and Singapore is already in place since January, 2010.

Only applicants who work in Shanghai, Zhejiang and Jiangsu areas and whose company dispatch letter and business license mention these areas can apply for a visa at the Shanghai visa application centre. The ID card of these areas is not enough.

The information is specific to people from Shanghai , Zhejiang and Jiangsu who wish to make a visa application to visit India . The Consulate General of India, Shanghai issues business, student, employment, tourist, entry and other types of visas to Chinese and other nationals.

All applicants from Shanghai , Zhejiang and Jiangsu seeking visas to visit India [except those holding diplomatic/official/public affairs passports] are requested to submit their applications at:

Applicants will be charged a service charge of RMB 165 (inclusive of taxes) per passport in addition to regular visa fees.

From March 6, 2008, visa applications are not being accepted at the Consulate, except for those holding diplomatic/official/ public affairs passports, who may continue to submit their visa applications at the Consulate between 0930 hrs and 1200 hrs on all working days.

Tourist Visa Advisory

This is for information that there should be a gap of at least 2 months between two visits to India on a Tourist Visa.

In case of requirement to visit India within 2 months, permission should be sought from the Indian Consulate at Shanghai directly without going through the outsourcing agency India Visa Application Centre. Where permission is accorded in such cases, registration with the local FRRO/FRO would be required within 14 days of arrival in India. Click here for the Request form. Processing time of the request will be 3-4 working days.

However, those holding Tourist Visas, who after initial entry into India plan to visit another country and re-enter India before finally exiting, could be permitted more than one entry, as the case may be, subject to their submission of a detailed itinerary and supporting documents i.e. confirmed Air tickets.

In view of the change in the Tourist Visa procedure, Government of India has fixed RMB Eighty Five (RMB 85) as Miscellaneous Charge for according permission to re-enter India within Two months of last exit.

GENERAL GUIDELINES

     

Who can apply for visa?

     

All foreign nationals, save exceptions, entering India are required to possess a valid international travel document in the form of a national passport or UN Laissez Faire with a valid visa obtained from an Indian Mission or Post abroad. Visa requests of Taiwan residents are not entertained here.

     

At the time of submission of visa application, passport of all applicants should be valid for at least six months

and should have sufficient pages for affixing visa sticker and stamping by immigration authorities.

Longterm visa

What is required to apply for visa?

     

All applications need to be completed and signed by the applicant himself. No incomplete application will be accepted. Applicants are solely responsible for the applications they submit. Any false documents or other misrepresentation of information in support of their application will have a direct bearing on the judgment of their application by the Consulate General of India . Applications can be submitted in person or can be sent through representatives. Application forms should be filled in English only. All photos should be identical.

     

Essential documentation:

     

Chinese nationals are required to submit a copy of their ID Card. Foreign nationals are required to submit a copy of their Foreigner Resident Permit (Green Booklet issued by the Public Security Bureau) or Alien Employment Permit (issued by the Labour Department). Note: Those holding multiple passports of different countries must apply only on the passport on which Chinese visa is affixed. Pakistani nationals can apply only on their national passport, irrespective of the passport on which Chinese Visa is affixed.

     

Foreign nationals on short-term visit to PRC in the Consulate's jurisdiction [Shanghai, Zhejiang and Jiangsu] wishing to visit India for the purpose of tourism are expected to have planned their visit to India and should have taken Indian visa from the country of their normal residence before proceeding. In exceptional situations, they are allowed to apply at the Center but processing time for such applicants is longer [upto 6 working days]. They may be called to the Consulate for a personal interview, if necessary.

 

Entry visa

Note: Entry visa is extendable in India at the local Foreigners Registration Office, whereas Tourist visa is not. Moreover, there should be a gap of at least 2 months between two visits to India on a Tourist Visa.

Family members/dependents of a Chinese /Foreign national who is granted Business Visa will be granted 'X' (Entry) Visa. Its validity shall be co-terminus with the validity of the visa of the principal visa holder.

Chinese spouses and Chinese children of Indian nationals should invariably apply for Entry visa. Kindly see the Note above for the reasons.

For the same reasons, the correct category of visa, foreign passport holders of Indian origin should apply for is Entry visa, for visits to India other than business, employment, education, conference, journalism & medical.      

Change of purpose:

     

Conversion of business visa or any other type of visa into employment visa is not permitted. Chinese nationals desiring to do so must return to their country and apply to the Indian Embassy/Consulate for Employment Visa furnishing all relevant papers required for grant of employment visa. Also please refer to 'Documents required' section for detailed information.

Validity:

     

Please note that validity of visa starts from the date of issue and not from the date of travel.

Please verify your particulars on the Visa after collection of your passport. Errors if any should be brought to the attention of the Indian Consulate directly.

     

Registration in India :

     

All foreigners including foreigners of Indian origin intending to stay in India for more than 180 days are required to register within 14 days of arrival with the Foreigners Regional Registration Office [FRRO] where they will be staying. FRRO also handles visa extension service in India . It maintains offices in New Delhi , Mumbai (Bombay), Chennai (Madras), Kolkata (Calcutta), and Amritsar .  In smaller cities and towns, the local police headquarters will normally perform this function. E
ach visa application is considered on its merits and the Consulate may ask for additional information at any stage during the processing of the application. Submission of application along with prescribed fee does not guarantee issuance of visa. If visa is refused, the applicants forfeit the entire fee paid and no refund is made.

     

The following types of visas are issued by the Consul Consulate General of India , Shanghai :

Tourist Visa

Note: Tourist visa can neither be converted nor extended.

     

(A) 3 months Single Entry Tourist Visa can be granted on presentation of a confirmed return air-ticket and proof of Bank deposit of RMB 10,000

(b) Group Tourist Visa: For group tourist visas (four or more), the application has to be supported by documents from the local tour operator arranging the trip and its Indian counterpart and should contain the detailed itinerary. Four copies of the list containing the full name, nationality, address, date and place of birth and passport particulars of each member of the group should be submitted along with completed application forms and passports.

Business Visa

     

Note: Applicants going for projects and contracts in India should apply for EMPLOYMENT VISA, [for Power and Steel projects under Project Visa] not for BUSINESS VISA. Companies applying for business visas for foreigners other than Chinese nationals should specify in the dispatch letter whether such employee has been resident in China for more than two years. 

     

Business Visas shall be granted to those who wish to visit India for the purpose of trade, short-term project work and business related activities. Following categories of Business visas are issued:

(a) Six months Multiple Entry Business Visa: can be granted on a letter of invitation from a "Recognized Indian Organization" i.e. from recognized Chambers of Commerce or industry associations or other trade bodies, public sector undertakings, government-approved joint ventures, liaison offices or private sector companies who are members of a recognized chamber of commerce or industry association or other trade body, along with a copy of the Certificate of Incorporation of the Indian Company or Pan Card in the name of company or small scale registration certificate or shops and establishment certificate issued by the local State Government and a Guarantee letter from the Chinese company.

Note: Applicants issued 6 month Multiple Entry Business visa shall not stay for more than 90 days on each visit.

(b) 2 months Single Entry Business Visa: can be granted on producing a letter of request from a "duly authorized Chinese organization" i.e. from Ministries and Commissions of the State Council, the Governments of all Provinces, Autonomous Regions and Municipalities directly under the Central Government, Foreign Offices and Bureaus of Economy and Commerce thereunder, Departments and Units recognized by the Department of Consular Affairs of the Ministry of Foreign Affairs of the People's Republic of China and CCPIT along with a copy of the Certificate of Incorporation of the Indian Company or Pan Card in the name of the company or small scale registration certificate or shops and establishment certificate issued by the local State Government and a Guarantee letter from the Chinese company.

     

[Note: Letter of invitation from Indian company and the letter of request from the Chinese company, must indicate the name, designation, and place of work (with telephone numbers) of the person for whom visa is required.   It must also indicate the purpose of the visit and the duration for which visa is required.  The letter must be a signed one, indicating the name, designation and contact details of the individual issuing the dispatch letter, with the seal/chop of the company alongside. Checklist for Business Visa applications

Eligibility

Business Visa is granted to a Chinese/Foreign National for the following purposes:

  1. Chinese/Foreign National who wish to visit India to establish an industrial/business venture or to explore possibilities to set up industrial/business venture in India.
  2. Chinese/Foreign nationals coming to India to purchase/sell industrial products or commercial products or consumer durables.
  3. Chinese/Foreign Nationals coming to India for technical meetings/discussions, attending Board meetings, general meetings for providing business services support.
  4. Chinese/Foreign Nationals coming to India for recruitment of manpower.
  5. Chinese/Foreign Nationals who are partners in the Business and/or functioning as Directors of the company.
  6. Chinese/Foreign Nationals coming to India for consultations regarding exhibitions or for participation in exhibitions, trade fairs, business fairs, etc.
  7. Chinese/Foreign buyers who come to transact business with suppliers/ potential suppliers at locations in India, to evaluate or monitor quality, give specifications, place orders, negotiate further supplies etc., relating to goods or services procured from India.
  8. Chinese /Foreign experts & specialists on a visit of short duration in connection with an ongoing project with the objective of monitoring the progress of the work, conducting meetings with Indian customers and/or to provide some high level technical guidance.
  9. Chinese/Foreign Nationals coming to India for pre-sales or post-sales activity not amounting to actual execution of any contract or project.
  10. Chinese/Foreign Trainees of multinational companies/corporate houses coming for in-house training in the regional hubs of the concerned company located in India. 
  11. Chinese /Foreign students sponsored by AIESEC for internship on project based work in companies/industries.
  12. Chinese/Foreign nationals coming as tour conductors and travel agents and /or conducting business tours of foreigners or business relating to it etc.

As per the MoU on Simplification of Visa procedures signed between the Republic of India and the People's Republic of China in June, 2003 the following categories of Business visas (applicable for PRC nationals) are issued:

  1. Six months Multiple Entry Business Visa: may be issued on the basis of a letter of invitation from a "Recognized Indian Organization" apart from other documents specified in the checklist.
  2. 2 months Single Entry Business Visa: may be issued on production of a letter of request from a "duly authorized Chinese organization" apart from other documents specified in the checklist.

Documents required:

  1. Original / Fax copy of Invitation letter from a recognized Indian company.
  2. Certificate of Incorporation of Indian company
  3. Dispatch letter from the company of applicant (Details should include the purpose of visit, annual income of the applicant and undertaking of the financial guarantee)
  4. Business License of Chinese Company authenticated in English.
  5. CCPIT registration/certificate of incorporation of the Chinese company.
  6. Itinerary.
  7. Other documents as specified in Checklist.

Visa to family members of a Chinese/Foreign nationals granted Business Visa

Family members /dependents of a Chinese/Foreign national who is granted Business Visa will be granted 'X' (Entry) Visa. Its validity shall be co-terminus with the validity of the visa of the principal visa holder.

Conversion of Business Visa

Business Visa cannot be converted to any other kind of visa during the stay of the Chinese/ Foreign national in India except in the following circumstances and with the prior approval of the Ministry of Home Affairs:

  1. Business visa may be converted to 'X' (Entry) Visa if a Chinese/Foreign National who has come to India on Business Visa marries an Indian National during the validity of his/her Business visa and does not intend to continue on Business Visa.
  2. Business visa of a foreigner who falls ill after his/her entry into India rendering him/her unfit to travel and requiring specialized medical treatment, may be converted to a Medical visa if he/she is eligible for grant of the Medical Visa and a medical certificate is obtained form a government/government recognised hospital.

Student Visa

     

A)      3 months Student Visa (for self-financed study): may be granted on presentation of a letter of admission from a recognized educational institution and proof of finances to cover to and fro journey and their stay in India .

Note: Students after their arrival in India shall apply directly to the Ministry of Home Affairs, Govt of India for Visa extension, residential permit and multiple entry & exit within 30 days after arrival and 30 days before the expiry of the 3-month period of the initial visa granted.

(B) Student Visa (under cultural/education exchange programme): can be granted for the full period of residency in India on presentation of a letter of authorization from the concerned Government body.

Transit Visa

Is issued for a maximum period of 15-days with single entry facility to bonafide transit passengers only.

Journalist Visa

Is issued to professional journalists and photographers. The applicants are required to contact on arrival in New Delhi , the External Publicity Division of the Ministry of External Affairs and in other places, the Office of the Government of India's Press Information Bureau.

Conference Visa

    

1 month Single Entry Conference Visa is issued to applicants attending International Conferences/seminars/workshops. 

     

Note:


a. Application for Conference Visas in respect of Chinese nationals should be submitted at least 06 weeks prior to the commencement of the conference.

b. In case the applications are submitted less than 06 weeks prior to the commencement of the conference, applicant should submit a letter (original/fax copy only) addressed to the Consulate from the organizer stating that the personal particulars of the participant have been submitted by the organizer to Ministry of Home Affairs in the prescribed format 06 weeks prior to the commencement of the conference.

c. In addition, the following documents should also be submitted by the applicant in case of both (a) & (b): (i) invitation letter from the organizer, (ii) event clearance from the Ministry of Home Affairs, (iii) administrative approval of the nodal Ministry, (iv) political clearance from Ministry of External Affairs and(V) clearance from the State Government/Union Territory.

4. Participants from other countries should produce along with the visas application: (i) Invitation letter from the organizer, (ii) event clearance from the Ministry of Home Affairs, (iii) administrative approval of the nodal Ministry, (iv) political clearance from the Ministry of External Affairs and (v) clearance from the State Government / Union Terriotory concerned.

5. PARTICIPANTS FOR INTERNATIONAL CONFERENCES IN INDIA MAY NOTE THAT THEY SHOULD APPLY ONLY FOR CONFERENCE VISAS AND NOT FOR ANY OTHER CATEGORY OF VISA.

     

Checklist for Conference Visa applications

     

Employment Visa

     

Note: Applicants for Employment visa in China should at the same time also apply at Ministry of Home Affairs (MHA), Foreigners Division in Delhi, India . Copies of the applications should be sent to Mr.P.S.Sivaraman, Deputy Secretary (F), Ministry of Home Affairs, Telefax No. 00-91-11-23383888 either through their representatives in India or through the Indian company with which they have signed the Contract. Conversion of business visa or any other type of visa into employment visa is not permitted. Chinese nationals desiring to do so must return to their country of permanent residence and apply to the Indian Embassy/Consulate for Employment Visa furnishing all relevant papers required for grant of employment visa. Employment visa is issued only after approval from concerned authorities in India , which may take 2 to 3 months.

     

A) 3 months Single Entry Employment Visa for opening Representative Office in India: can be granted on presentation of a letter of approval issued by the Government of India for opening the office with a copy of terms and conditions thereof to Chinese nationals visiting India as Head and Deputy Head of a representative office of a Company or Organization.

(B) 3 months Single Entry Employment Visa for employment including for contracted projects: can be granted on production of approval letter by the project contacting authority in India, letter of appointment, terms & conditions of appointment, proof of his/her previous employment, short profile of experience/expertise in case of his/her first employment and no criminal record.

(C) Single Entry 3 months Entry Visa to Employee's accompanying family members: can be granted on presentation of documentary proof of relation with the employee and a sponsorship letter from the employer.

Note: The employees and accompanying family members after their arrival in India shall apply directly to Foreigner's Division, Ministry of Home Affairs for Visa extension, residential permit and multiple entry & exit within 30 days after arrival and 30 days before the expiry of the 3-month period of the initial visa granted.


(D)
3 months Single Entry Tourist Visa to non-accompanying spouses/children/relatives of Employees: can be granted on production of an invitation letter from the employers.

Eligibility

Employment visa is only granted to an applicant who is highly skilled and / or qualified professional and is not granted for unskilled, routine, ordinary or secretarial / clerical jobs.

Employment Visa may be granted to the following categories of Chinese / foreign nationals:

  1. Chinese/Foreign nationals coming to India for employment in a company/firm/organization registered in India or for employment in a foreign company /firm/organization engaged for execution of some project in India.
  2. Chinese/Foreign engineers/technicians coming to India for installation and commissioning of equipments/machines/tools in terms of the contract for supply of such equipment/machine/tools.
  3. Chinese/Foreign personnel deputed for providing technical support/services, transfer of know-how/ services supplies for which the Indian company pays fees/royalty to the foreign company.
  4. Chinese/Foreign nationals coming to India as consultant on contract for whom the Indian company pays a fixed remuneration (this may not be in the form of monthly salary).
  5. Chinese/Foreign artists engaged to conduct regular performances for the duration of the employment contract given by Hotels, Clubs, and other organizations.
  6. Chinese/Foreign nationals who are coming to India to take up employment as coaches of national/state level teams or reputed sports clubs.
  7. Chinese/Foreign sportsmen who are given contract for a specified period by the Indian Clubs/organizations.
  8. Self-employed Chinese/Foreign nationals coming to India for providing engineering, medical, accounting, legal or such other highly skilled services in their capacity as independent consultants provided the provision of such services by foreign nationals is permitted under law.
  9. Chinese/Foreign language teachers/interpreters.
  10. Chinese/Foreign specialist Chefs

  1. Letter of Appointment from Indian company/ or Copy of the contract signed between two parties.
  2. CV of the applicant.
  3. Documentary proof of the educational qualification.
  4. Professional expertise certificate
  5. Registration certificate of the employing company under the Companies Act / Proof of registration of the firm in the State industries department or the Export Promotion Council.
  6. No-Criminal record certificate issued by the PSB/Police and duly attested by Notary.
  7. Other documents as specified in Checklist.

Visa to family members of a Chinese/Foreign nationals granted Employment Visa
Family members /dependents of a Chinese/Foreign national who is granted Employment Visa will be granted 'X (Entry)' Visa. Its validity shall be co-terminus with the validity of the visa of the principal visa holder.

Conversion of Employment Visa

Employment Visa cannot be converted to any other kind of visa during the stay of the Chinese/ Foreign national in India except in the following circumstances and with the prior approval of the Ministry of Home Affairs:

  1. Employment visa may be converted to 'X' (Entry) Visa if a Chinese/Foreign National who has come to India on Employment Visa marries an Indian National during the validity of his/her employment visa and does not intend to continue on Employment Visa.

  2. Employment visa is issued only after approval from concerned authorities in India, the processing of which may take 45-50 days.

PROJECT VISA

New Project Visa Category launched for projects in steel and power sector

Project Visa may be granted to Chinese / foreign nationals coming to India for execution of projects in the power and steel sectors, subject to the following conditions:

  1. Project visa will be issued only to highly skilled / skilled persons and not to semi-skilled/un-skilled workers.
  2. A Project Visa holder cannot engage in another project either of the same company or of a different company
  3. Employment / Work of the Project visa holder would be restricted to the location of the project.
  4. Validity of visa would be initially for the duration of the project/contract with multiple-entry facility. It cannot exceed one year.
  5. A person coming for Project Visa cannot take employment in the same Indian company for a period of two years from the date of commissioning of the project.
  6. Project Visa would be issued based on the submission of the relevant documents clearly establishing that the project / contract has been assigned to the particular foreign company by the Indian company / organization concerned.
  7. Project Visa can be issued to 2 chefs and 2 interpreters per project.
  8. Indian company engaging the foreign national for executing the project / contract would be responsible for the conduct of the foreign national during his / her stay in India and also for the departure of such foreign national upon expiry of visa.
  9. Project Visa holder would have to register with the FRO/FRRO concerned within 14 days of arrival if the validity of visa is more than 180 days.

* For additional units to qualify as a separate project at the same location, there should be a gap of minimum one year in the date of award of contract between two such projects

B. Steel Sector

Green Field Projects -   10% of the total skilled manpower deployed per mln tonne capacity or 300, whichever is lower
Brownfield Projects -   5% of the total skilled manpower deployed per mln tonne capacity or 150, whichever is lower

  • Total Manpower requirements of the project should be determined at the stage of conceptualization of the project by the sponsoring authority with a flow-chart
  • For the purpose of determining the capacity of the Unit, it would be the approved capacity as certified by the Ministry concerned of the Government of India in respect of PSUs. In respect of private sector steel units, the basis of capacity may be as per the financial disclosure statement of a Scheduled Bank or RBI-approved NBFC duly authenticated and certified.

Documents required:

  1. Letter (original / fax) from the Indian Company awarding the contract to the foreign company   specifying the following details:

    1. Name of the foreign Company
    2. Registered address of the foreign company
    3. Name of the project awarded as per the tender document
    4. Location of the project in India (village/town/district/state)
    5. Duration of the contract (number of days)
    6. Total number of foreign workers likely to be sent by the foreign company (category wise)

      1. Highly skilled
      2. Skilled technicians with diploma/polytechnic degree
      3. Skilled workers with school level education


  2. Letter (original / fax) from the Indian company addressed to the Indian Mission explicitly stating that:

    1. It guarantees the conduct of the foreign company and the foreign personnel involved in the execution of the project/contract.
    2. It would be responsible for ensuring that the applicant (name of the applicant, passport number and date of birth shall be mentioned) will abide by Indian rules and regulations.
    3. It will be liable to ensure departure of the applicant from India upon expiry of Visa.

  3. Letter from the foreign employer providing brief description of the nature of its project in India and a brief description of the job which the applicant is required to perform in India.
  4. CV of the applicant.

Medical Visa

The medical visa would be admissible to all foreigners seeking Medicare in recognized specialty hospitals or treatment centers in India . Although non exhaustive, following illustrative list of serious ailments would be of primary consideration; neuro-surgery; ophthalmic disorders; heart related problems; renal disorders; organ transplantations; plastic surgery; joint replacement etc. The initial period of such a visa will be one year or for the period of treatment whichever is less. Unlike the tourist visa, this can be extended in India , with supporting Medical documents. Such visa will be valid for maximum three entries during one year. The applicant should seek preliminary medical advice from China and should have been advised to go for specialized medical treatment. Foreigners visiting on 'M visa' will be required to get themselves registered mandatorily well within the period of 14 days of arrival with the concerned FRROs/ FROs. Attendant/family members of the patient coming to India for medical treatment shall be granted miscellaneous visa co-terminus with the 'M Visa' of the patient. Such visa may be granted to the spouse/ children or to those who have blood relations with the patient.
